The term “Personal information” refers to “personal data” as defined by the applicable US law related to data protection. The term “processing” is defined as collecting, storing, and utilizing personal information for our services. Your Account Data is under your control as the data controller specified by the applicable US law related to data protection, while all other personal information is under the control of NattyTech, LLC. Our servers are located in the US, and if you or others access your data from outside the US using our services, you may be accessing it from a country without adequate personal information protection dictated by the applicable US law related to data protection. Our Terms of Service authorize us to grant this access

We will collect, store, use, and otherwise process Account Data so that we can provide the services you have contracted to obtain from us under our Terms. We also have a legitimate interest in processing Account Data so that we can maintain and improve our systems and services and communicate with you as referenced in this Policy.

Cloud Storage Services

The following section of this section pertains to Your Files, which refers to the files you upload, access, and share through our services.

When you upload a file, it is already encrypted on your device, and we have no knowledge of its contents or origin. Although we generate and store encrypted previews of images, videos, audio and certain other types of files, we gather only minimal metadata that does not disclose their contents.

Data Collection

We collect certain information from our users when they use our cloud storage app and our file storage and sharing services. This information may include personal data such as email address, name, contact list information, images, videos, audio files and other types of files that users upload through the app and the website. We collect this data in order to provide our services and enhance the user’s experience while using our app. Users must explicitly grant access before any data is shared. Users’ uploaded files are securely stored on a third-party server to ensure maximum protection.

Usage & Sharing of Collected Data:

This is the section of this policy that covers the usage of the data you consent to share with us, and metadata and records of financial transactions that we generate in relation to Your Files, Your Chats, and your account. The following specific terms apply:

We collect Your Files to provide cloud storage and collaboration services, as contracted through our Terms. Users’ uploaded files are securely stored on a third-party server to ensure maximum protection.

While we store and provide access to Your Files from servers in the US that offer adequate protection under the applicable US law related to data protection, none are stored or made available elsewhere.

When you sign up for particular services on NattyTech, you will need to give us the details required in our registration form and will need to keep that information up to date, including any payment account details (e.g. online payment provider account information).

You do not need to provide us with any information other than an email address to use a free NattyTech account. However, the volume of Your Files that you can store and some other functionality is limited with such accounts. If you wish to access greater storage and other functionality under a paid plan, you will need to give us (including our related or affiliated entities, payment processors, and resellers) the information (such as payment information) that is required under the particular plan and our terms in relation to those services. For paid plans, NattyTech and its related or affiliated entities, payment processors, and resellers that you use to make payments, retain account and payment information, including a record of all transactions on your account.

When you use our services, our systems retain the following metadata in unencrypted form:

– Browser type and operating system of the devices from which you have logged in to NattyTech;

– IP address and port information for logins, API usage, file uploads, folder creations, and link exports;

– The country that we expect you are accessing our services from (inferred by matching your IP address to a public IP address database);

– File sizes, versioning order, timestamps, and parent-child file relationships;

– Deletion timestamps;

– The email address of anyone you have specifically made contact with using NattyTech’s systems. Note that Your Files and folders can be shared privately by invitation to specified email addresses or shared more generally by creating a file or folder link and decryption key;

– Contact email addresses, chat commencement time and chat duration, and moderation activity;

– Takedowns and account suspensions;

– Our communications with you; and

– Your personal account settings, including any avatar picture.

Access to your account on NattyTech is done through a designated email address and password. It is your responsibility to keep these safe and secure as NattyTech stores the email address but does not store the password. If you forget your password, we will always attempt to send a recovery password email so that you can regain access to your data. However, it is important to ensure that your password is always remembered and kept protected to avoid any disruptions in accessing your account.

At NattyTech, we may collect and use Usage Data as part of our efforts to improve and provide our services. This data may be joined with other users’ data and shared with advertisers but never in a way that personally identifies any user. We may also use Usage Data for marketing and statistical purposes and serve advertisements through third-party advertising companies.

We only collect and retain Usage Data with your consent, which may be used for market research and to provide services and support related to our offerings. We may also provide users with promotional material and special offers on our services via Usage Data.

Data Retention:

Your Files remain stored with us while you use our services, subject to our suspension and termination guidelines outlined in our Terms. While we make no guarantees regarding data loss or service bugs, you should download Your Files before termination of service or password loss (except where a Recovery Key has been exported). Deletion of Your Files occurs either upon your deletion or account termination, subject to any retention specified in this Policy or our Terms.

In some cases, such as a breach of our Cookie Policy or current or anticipated legal actions, we may retain Your Files after account suspension or termination for evidential purposes.

We retain Account Data as long as your account is active. After account suspension or termination, including where the administrator of a business account within which you have used the services terminates that business account, we may, but shall not be obliged to, retain all Account Data if enforcement action is likely or commenced under our policies, or for 12 months, whichever is longer, or in the case of records of financial transactions relating to your account for such period of time as we are legally required to retain such information. Users sometimes request that an account be reactivated, so we keep Account Data for 12 months for that purpose. Where there is no enforcement action likely or commenced and the 12-month period has expired, or after such a longer period as is applicable in the case of records of financial transactions relating to your account that we are legally required to retain, Account Data that identifies you will be anonymized. However, where you are a contact of, have had a folder shared with you by, or have chatted with another NattyTech user, those details will continue to be retained to allow services to continue for those other users.

We will not access or disclose any of your personal Information other than as required for us to provide you with our services, to comply with our legal obligations, or as necessary in order to investigate and respond to suspect fraud, abuse, or other illegal activity.

We will use reasonable efforts to protect the security of any information we collect. This includes using industry-standard encryption technology to secure data transmitted to and from our website, appropriate firewalls and technological safeguards to protect the privacy and security of your information and third-party vendors to provide reasonable security measures in order to secure our database.

While we take precautions to help protect your information, no system or transmission of data over the internet or any other public network is completely secure, so we cannot guarantee the security of your information.

We urge you to use best practices to ensure system and device safety. NattyTech will never request your password by email. We cannot guarantee computer or device security or transmission safety over the internet and will disclose data to enforcement authorities if required by law.

5. Data Retention

We reserve the right to retain information in accordance with applicable laws. We will delete data upon request; however, due to technical constraints, we may not be able to delete all data stored in our systems.

6. Third-Party Services

We may employ or use third-party vendors and services to provide certain services or features on our Site. These services may include hosting, website analytics, payment processing or other services. These third parties may collect and store data about you as part of providing their services. We do not control, nor are we responsible for, these vendors and services.
